RELIEF FOR MAN AGAINST WIFE’S FALSE CASES

The Delhi High Court rejected the petition of a woman, who was filed false case against her husband regarding dowry harassment and adultery to his superiors, and the High Court upheld the trail court verdict stating that that she was failed to produce evidence regarding harassment, and ended his suffering on the grounds of mental cruelty.

MARITAL RAPE IS NOT A CRIMINAL OFFENCE, IF GIRLS AGE IS ABOVE 15: SUPREME COURT

The Supreme Court said that marital rape can’t be considered as criminal act, and said that man forcibly having sex with his wife above 15 years of age is not marital rape, due to an exception in Section 375 of the Indian Penal Code (IPC) rape law, and also asked the Centre to provide data on the number of Child Marriage Prohibition Officers, appointed under the Child Marriage Prohibition Act, 2006 as well as the number of prosecutions that have been instituted over the last three years under the Act.

MOTHER-IN-LAW SUPPORT HER DAUGHTER-IN-LAW IN ALIMONY CASE

A family court in Bangalore city has directed Devanand Shivashankarappa Kashappanavar, son of the late former Karnataka minister S R Kashappanavar, to pay Rs 4 crore as permanent alimony to his wife within 60 days. In this case Devanand’s mother deposed in court in support of her daughter-in-law.

NO ARREST IN 498-A, BEFORE COMMITTEES REPORT SUPREME COURT OF INDIA

HYDERABAD HIGH COURT CLEARED JOBS FOR CHILDREN OF SECOND WIFE

Hyderabad High Court had strike off the orders of the Railway Board rejecting compassionate appointments to the children of the second wife of deceased railway employees, and said that according provision of the Hindu Marriages Act, the children of second wife are legitimate, even though the marriage with second wife is void if the first marriage is legally valid.

FAMILY COURT IN HYDERABAD ORDERED TO PAY COURT FEE FOR DIVORCE PETITION

A family court in the Hyderabad directed a 53-year-old woman petitioner, who had approached the court for divorce under the Hindu Marriage Act Section 13(1) (ia) and permanent alimony under Section 25, to pay a ‘court fee’ of Rs. 30,000 as per the Andhra Pradesh Court Fees And Suits Valuation Act, 1956.
