DELHI HIGH COURT REFUSED TO INTERFERE IN NRI WOMAN’S CUSTODY BATTLE

The Delhi High Court has asked an NRI woman to return to the US with her minor daughter and a toddler, refusing to interfere in child custody battle with her estranged husband, and dismissed an appeal filed by her seeking to invoke High Court’s jurisdiction to contest child custody, saying that only the US court can decide her plea.

EVEN A WOMAN CAN BE BOOKED UNDER DOMESTIC VIOLENCE ACT

Hyderabad High Court said that an aggrieved woman can seek protection under the Domestic Violence Act, 2005 even against a female member of the family, provided she satisfies provisions of the Act, but also said that according to Domestic relationship as per section 2 (f) of Domestic Violence Act, 2005, to have domestic relation the two persons should live together or have, at any point of time, lived in a shared accommodation, and granted  relief to a woman by quashing the proceedings pending against her which was filed by her mother-in-law under the provisions of the Act seeking protection against their son and daughter-in-law, and for maintenance.
