DISSOLUTION OF MARRIAGE OUT-OF-COURT IS NOT VALID

Any marriage dissolution or annulment is valid only through a court of law and it is not valid if it is settled out of court through an amicable agreement or understanding or proceeding. However, a child born to them is entitled to claim maintenance. As per Section 16 of the Hindu Marriage Act, even a child of void marriage is legitimate for all purposes, including for purpose of succession, entitlement of maintenance and so on.

SUPREME COURT ORDERED FOR DNA TEST TO SOLVE RIDDLE OF PARENTHOOD

The Supreme Court faced a strange matrimonial dispute with a man at the centre of two marriages. The man owned up one marriage and claimed that the other was being foisted upon him by another woman with two children. After hearing the matter the Court asked the woman, man and children to undergo DNA profiling. The Court asked the authority to furnish the DNA report analysis to the court in eight weeks.

PARSI WOMAN APPROACHED SUPREME COURT TO CHALLENGE OLD PARSI DIVORCE LAW

A Parsi woman, who had filed Parsi matrimonial suit before the Bombay High Court seeking dissolution of her 11-year-old marriage, has moved the Supreme Court questioning the validity of many provisions of Parsi Marriage and Divorce Act (PMDA), alleging that these made estranged couples of her community go through a torturous exercise to get divorce, because High Court has been not appointed any delegates to deal these cases.

Aligarh Muslim University professor’s wife registered a complaint against his husband that he gave Triple Talaq (divorce) to her on Whatsapp. The wife alleged her husband Khalid Bin Yusuf Khan, professor and chairman at the Department of Sanskrit at the university had turned her out of the house with the children.

MUSLIM WOMEN CAN FILE DEFAMATION CASES OVER PUBLIC TALAQ (DIVORCE)

Law Experts said that women who have been divorced by their husbands with a talaq (divorce) notice levelling unproven defamatory allegations against them (in newspapers or sent to their homes), can now file both a criminal case and a civil defamation suit, against the husband or his family members or any other person who abets them.

HUSBAND CONSENT IS NOT MUST FOR ABORTION: SUPREME COURT

The Supreme Court has upheld the decision of the Punjab and Haryana High Court and dismissed a man’s petition seeking damages from his estranged wife for undergoing abortion without his consent, and ruled that an adult woman had an unimpeachable right to give birth or terminate pregnancy. Earlier the man filed a plea in the High Court terming the abortion, to which he had objected, ‘illegal’, the husband had also demanded compensation from the woman’s parents and brother, and two doctors.
