WOMAN COMPLAINED AGAINST NIKAH HALALA, COPS FILED FIR AGAINST HER HUSBAND, FATHER-IN-LAW

Bareilly (Uttar Pradesh) police have filed an FIR against a man, his father and other family members were booked under 498A (dowry), 323 (voluntarily causing hurt), 328 (causing hurt by means of poison), 511 (attempting to commit offences punishable with imprisonment for life or other imprisonment) and 120B (criminal conspiracy) after the man’s wife alleged that she was given divorce multiple times and forced to consummate marriage with other men, including her father-in-law, as part of the nikah halala practice. The father-in-law has been booked under section 376 (rape) and the husband under 377 (unnatural sex) as well.

The Delhi High Court observed that marriage does not mean that a woman is always consenting for physical relations with her husband, and also held that physical force is not necessary for constituting the offence of rape. The court said that in a relationship like marriage, both man and woman have a right to say ‘no’ to physical relations. PERSONS WHO THREATENS LAWYERS MAY FACE SEVEN YEARS JAIL TERM: SOON BILL BY MADHYA PRADESH GOVERNMENT TO PROTECT LAWYERS

The Madhya Pradesh state cabinet gave its approval to the Advocates Protection Act. Under this Act, a person accused of exerting undue pressure on a lawyer or obstructing their work would lead to seven years of jail with provisions of fine up to Rs. 10,000. The government is preparing to bring an Ordinance to implement this Act soon. The government will present the bill in the monsoon session of the Assembly.

CENTRE OPPOSED PLEA IN SUPREME COURT THAT SEEKS TO MAKE WOMEN ALSO LIABLE FOR CRIME OF ADULTERY

The Centre opposed in the Supreme Court a plea to reconsider the legal validity of the 157-year-old adultery law under Section 497 of the Indian Penal Code punishing only the man and not the married woman for adultery, treating her as a victim, not an abettor of crime. Currently under Section 497 of the IPC, the crime is applicable only to the man who has sexual relation with a woman who isn’t his wife.

MUSLIM WOMAN CAN’T SEEK MAINTENANCE UNDER HINDU MARRIAGE ACT: MADHYA PRADESH HIGH COURT

Madhya Pradesh High Court has ruled that maintenance under Hindu Marriage Act is substantive right of a wife but under Muslim law, a woman has the right to sue her husband for maintenance only if he neglects or refuses to maintain her without any lawful cause, and reversed the order of a lower court, which had allowed application of a Muslim woman for interim maintenance under Section 24 of Hindu Marriage Act by saying that both the parties in the case are Muslims. However, the court said that if the wife wants interim maintenance, she is entitled to file an application under Section 125 of CrPC before a family court.

SON HAS NO LEGAL RIGHT TO STAY IN HOME WHICH WAS SELF-EARNED BY HIS PARENTS: DELHI HIGH COURT

The Delhi High Court ruled that the son has no legal right to stay at home where parents have earned themselves. If the son was allowed to stay at home at the time of good relations, it doesn’t mean that they want to carry the burden of that son’s life. He can live in the house as long as his parents permit him to stay in home. The verdict was observed while dismissing a plea filed by a son against lower court order that allows parents to evacuate their son and daughter-in-law from their self-earned home.

SUPREME COURT TO EXAMINE COMPENSATION FOR LIVE-INS IF MAN REFUSES MARRIAGE

The Supreme Court decided to examine whether civil liability could be fixed on a man to pay compensation in case he refuses to marry a woman with the promise to do so before entering a live-in relationship. The court passed this particular order while hearing a plea from a man who wanted the court to dismiss a criminal charge filed against him. The complaint was filed by the mother of a woman with whom the man had lived for six years, promising her marriage. However, he now refused to get involved in a marital relationship with her.
